Our services involve custom software development, which is typically delivered in phases or against agreed-upon milestones. Cancellations are handled with consideration for the work already performed, resources allocated, and any third-party expenses incurred up to the point of cancellation.


Cancellation Timeframe & Impact

Clients may request to cancel a project or specific service at any time. The financial implications of the cancellation will depend on the stage of the project at the time the cancellation request is received:

  • Before Project Commencement: If a project is canceled before any work has begun and before the initial deposit (if any) is processed, there will generally be no cancellation fees, and any deposit received will be fully refunded.
  • During Project Phases/Milestones: If a project is canceled while in progress:
    • Work Completed: You will be responsible for payment for all work completed and approved up to the date of cancellation. This includes any specific milestones that have been delivered and accepted.
    • Work in Progress: For work that is in progress but not yet completed on a specific milestone, a pro-rata charge will apply based on the percentage of that milestone completed.
    • Notice Period: We appreciate as much advance notice as possible. While there’s no fixed “notice period” fee, earlier cancellation allows for smoother transitions.

Cancellation Fees

Elvan Forge LLC does not typically charge a separate “cancellation fee.” Instead, any charges associated with a cancellation will be based on:

Third-Party Costs: Any non-recoverable costs incurred by Elvan Forge LLC on your behalf (e.g., software licenses, specific hardware purchases, or third-party service subscriptions acquired for your project) are non-refundable.

Payment for Services Rendered: As detailed above, you will be billed for all work completed and expenses incurred up to the point of cancellation.

Non-Refundable Deposits: Any initial deposits may be non-refundable if the project has commenced and work has been performed. This will be outlined in your specific project agreement or Statement of Work (SOW).

Exceptions

Circumstances where cancellation might not be possible, or where this policy may be modified, include:

  • Completed Milestones/Projects: Once a project phase or the entire project has been completed, delivered, and accepted by the client, it cannot be canceled for a refund.
  • Specific Contracts: Any unique terms or cancellation clauses explicitly stated in a signed project agreement, Statement of Work (SOW), or master service agreement will supersede this general policy.
  • Custom Orders/Licenses: For services involving the purchase of highly customized third-party tools, software licenses specifically for your project, or unique intellectual property, these costs may be fully non-refundable once acquired.

How to Initiate a Cancellation

Please include your project name/ID and a brief reason for the cancellation. Our team will acknowledge receipt of your request and guide you through the next steps, including the final financial reconciliation.
